Part 3. ChainPass Terms of Service

Effective date: [OPEN]. Version: [OPEN].

These terms are an agreement between you and ChainPass [legal entity name, OPEN], a Delaware corporation. They apply when you visit chainpass.io, enrol for a V.A.I., hold one, or use ChainPass pages and services. Platforms that integrate ChainPass also sign a separate Platform Agreement, which governs if it conflicts with section 13.

1. What ChainPass does

ChainPass verifies that a user is a real adult and the person on a government ID, and issues a V.A.I. number to that user. ChainPass administers agreements that platforms ask their users to sign and keeps the signed records. ChainPass does not run, endorse or supervise any platform or any activity on a platform. Each platform sets its own rules and decides what a verification result means for access to that platform.

2. Eligibility

You must be 18 or older, or the age of majority where you live if higher. You must use your own valid government ID and your own face.

3. Your V.A.I.

1. One person holds one V.A.I., for life. It is not reissued or reassigned to anyone else. 2. Your V.A.I. is personal. You may not share it, sell it, or let another user pass a face check for you. 3. A V.A.I. can be accepted on any platform that uses ChainPass. Each platform may require a higher credential level and its own terms. 4. The V.A.I. number belongs to you once your identity is confirmed. It becomes active when you finish registration and accept the platform's terms.

4. Enrolment

1. Before any image is taken you will be asked to sign ChainPass's biometric consent. Enrolment cannot continue without it. 2. You agree to provide true information and to complete each face capture in one unbroken camera session. A broken session voids that capture and you repeat that step. 3. You will be shown the terms of the platform you enrolled through and asked to accept them. You will be asked to accept the terms of any other platform on your first visit to it, and again when its terms change.

5. Background check

If a platform requires it, ChainPass sends your identity to its screening provider before your V.A.I. is issued. Today the check searches the sex offender registry. ChainPass records only the result: clear, or something on file. ChainPass does not decide what the result means. A platform may let you explain a result on that platform.

6. Fees, term and renewal

1. The price of a V.A.I. is shown before you pay. Current prices are set in the ChainPass pricing record and may change. A change never applies to a term you have already paid for. 2. A V.A.I. term runs for one year from the date it is issued, not from the date it is paid. 3. A platform may pay for a one-time courtesy period on your behalf. It is offered once per person. When it ends your V.A.I. becomes inactive but stays yours. You reactivate it by paying. The remaining term is counted from the original issue date. 4. Fees are not refunded once the verification has run, because the verification work has been done. 5. At renewal ChainPass checks two dates: your ID document's expiry and the verification provider's retention period. If either has passed, you complete a fresh verification. Otherwise ChainPass confirms you with a face check.

7. Agreements you sign through ChainPass

1. Signature Agreement. Where a platform requires the Pro level, you sign a Signature Agreement. It records your standing consent that documents you sign through ChainPass, with a face check, are signed by you. 2. Law Enforcement Disclosure (United States only). Users who sign in the United States are asked to state, under penalty of perjury, whether they are affiliated with law enforcement. The disclosure is given to ChainPass as a neutral party. A false statement exposes the signer to civil remedies by ChainPass. Users outside the United States are not asked to sign it. 3. Records. Every signed record is versioned and timestamped and is not altered after signing.

8. Account security and recovery

You are responsible for your security answers and backup codes. ChainPass cannot read them. If you lose them, recovery may require a fresh verification with ChainPass's provider.

9. Suspension

ChainPass may suspend a V.A.I. for non-payment, for use by someone other than the holder, for false information, or to comply with law. A suspended V.A.I. is withheld from use and is not deleted. ChainPass will tell you why unless the law prevents it.

10. Prohibited use

You may not use ChainPass to commit fraud, impersonate anyone, defeat a face check, probe or overload ChainPass systems, scrape data, or reverse engineer the service. Platforms may not use ChainPass to identify a user beyond what that user agreed to on that platform.

11. Intellectual property

ChainPass, V.A.I., VAI-CHECK and related marks belong to ChainPass or its licensors. The V.A.I. technology is patent pending.

12. Disclaimers and limits

1. A verification confirms identity and age at the time of the check. It is not a statement about anyone's conduct, character or safety. 2. ChainPass is not a party to any arrangement between users or between a user and a platform. 3. To the extent the law allows, the service is provided as is, and ChainPass's total liability to you is limited to the fees you paid ChainPass in the 12 months before the claim. [OPEN: counsel to confirm cap and carve-outs, including BIPA statutory damages exposure.]

13. Platforms

A platform may integrate ChainPass only under a signed Platform Agreement. Each platform must supply its own terms before it receives an API key. The platform terms must state what the platform requires ChainPass to collect and what ChainPass does with it. A platform receives only the data described in section 4 of the ChainPass Privacy Policy.

14. Law and disputes

These terms are governed by the laws of the State of Delaware. [OPEN: counsel to choose courts or arbitration, venue, and whether a class-action waiver applies. Consumer protection laws where you live still apply.]

15. Changes and contact

ChainPass will post changes here with a new effective date. A changed version is shown to you for acceptance on your next use. Contact: support@chainpass.io.
